3. 资格要求；账户与注册

4. 服务的使用；限制条款
A. 服务的使用
只要您遵守本使用条款，我们即授予您一项非独占的、有限的、可撤销的、个人性质的、不可转让的许可，允许您在您的移动设备上使用这些服务，并下载及使用任何应用程序（详见下文第4(B)节定义），仅限于个人用途。如果您是从事房地产或抵押贷款业务的专业人士，根据适用法律的允许范围，您还可以使用这些服务向客户提供信息，并代表客户采取相关行动（称为"专业用途"）。如果您出于专业用途使用这些服务，您需声明并保证已获得客户的全部必要授权和同意。除非本使用条款另有明确说明，否则这些条款并不授予您在第三方网站上使用、复制、分发、展示或提供服务任何部分的访问权限。这些服务可能包含用于配合服务使用的软件。这些服务不得用于商业房地产交易，包括但不限于商业用途的土地和度假租赁业务。
B. 移动应用程序

- 不得以任何方式使用本服务来歧视受联邦、州或地方法律保护的任何个人或群体，也不得使用本服务对任何个人或群体产生歧视性影响，更不得利用本服务促进非法、种族主义或歧视性的行为或结果。
- 通过服务（包括但不限于代理人个人资料页面）向任何第三方发布、展示、传达或以其他方式提供卖方或挂牌代理人的买方代理人报酬方案（包括报酬金额、比例，或是否提供此类报酬），无论该报酬方案是否与任何特定房产相关。
- 通过服务分发或发布垃圾邮件或其他未经请求的信息、连锁信、传销信息或类似内容；
- 冒充他人；虚假陈述自己与他人的关系或所属机构；或以虚假借口向任何第三方作出任何陈述；
- 不得在任何其他网站、应用程序或服务上复制、公开展示或以其他方式提供有关房地产、贷款或其他专业人士的任何评论、评级或个人资料信息，也不得提供房地产房源的图片或相关信息，或通过本服务获得的其他数据或内容，除非我们明确允许针对本服务的特定部分进行此类操作。
- 向服务中上传无效数据、病毒、蠕虫或其他软件程序；
- 发布、复制、公开展示或以其他方式传播任何内容，只要我们根据自身的判断和裁量权认为这些内容属于非法、具有攻击性或令人反感的内容即可。此类内容包括但不限于骚扰、歧视、贬低、威胁或诋毁任何个人或群体的内容。

- 在服务中使用 Blue Ocean Realty 公司的任何商标作为您的屏幕名称或电子邮件地址的一部分；
- 访问或使用任何服务来开发具有竞争力的产品或服务；或
- 试图、允许或鼓励任何第三方从事上述任何行为。
6. 费用
A. 通常情况下
您可能需要支付费用才能使用服务的某些功能。所有费用均以美元计，且不予退还。如果我们调整了任何服务的全部或部分费用（包括新增费用），将会提前通知您。如果您不同意这些费用变更，我们可能会停止为您提供相关服务。我们授权的第三方支付处理机构将根据您在购买时指定的支付方式或所选服务的要求进行收费。您授权我们按照本使用条款中规定的方式，通过您选择的支付方式收取所有费用。如果您使用信用卡支付费用，我们可能会在购买前请求对您的信用卡账户进行预授权，以确认信用卡有效且具有足够的资金或信用额度来覆盖您的购买金额。
B. 订阅服务
部分服务可能包含允许自动定期收费的功能（即"订阅服务"）。如果您决定激活订阅服务，即表示您授权我们从未来开始，直到您取消定期付款或账户为止，定期向您收取应付款项。除非您主动取消订阅或我们终止服务，否则订阅服务将持续有效。为避免下一期订阅费用被计入您的账户，您必须在订阅服务自动续订之前取消它。我们会将定期订阅费用通过您在注册时提供的支付方式（或如果您更改了支付信息，则通过新的支付方式）进行扣款。我们可能会调整后续订阅期的费用，但会在费用调整前提前通知您。除非产品条款另有规定，您可以通过账户设置页面、发送邮件至联系我们，或（如适用）联系您的业务顾问来取消订阅服务。
7. 用户资料
A. UGC定义；许可授予
本服务的某些部分允许用户上传或以其他方式提供Blue Ocean Realty公司的图片、照片、视频、数据、文本、房源信息及其他内容（以下简称"用户材料"）。除非您的产品条款中另有规定，否则通过将用户材料上传或以其他方式提供给本服务，您即授予我们一项不可撤销的、永久的、免版税的全球性许可： （i）在与本服务相关的任何媒介中，使用、复制、分发、传输、公开展示、公开表演、修改、编辑、制作衍生作品或将您的用户材料整合到其他作品中； （ii）在适用法律允许的最大范围内，再许可上述权利。 我们不会就您的用户材料支付任何费用，也不会行使前一句中所述的与您的用户材料相关的任何权利。我们可随时删除或修改您的用户材料。您需对通过您的用户账户在服务中创建的所有用户材料，或通过服务提供的所有用户材料承担全部责任。对于所有用户材料，您声明并保证自己是这些材料的创建者和所有者，或者拥有必要的许可、权利、同意书及权限（包括适用隐私法和知识产权法要求的所有权限），以授权Zillow公司及其他用户根据本使用条款获取并使用您的用户材料。 除非客户联系信息是由客户直接提供给我们的，否则我们不会将代理通过Blue Ocean Realty门户上传的客户联系信息用于任何目的。
B. UGC免责声明

Welcome and thank you for your interest in Blue Ocean Realty and its affiliated businesses (Blue Ocean Realty. and its affiliated brands, as detailed in Section 2, collectively referred to as "Blue Ocean Realty Company," "we," or "our company"). By clicking the register or create new account button, or by otherwise using our website, network, mobile applications, or other services provided by Blue Ocean Realty (collectively referred to as "Services"), or by accessing any content we provide through these services, you agree to comply with the following terms of use (referred to as "Terms of Use"), which may be updated from time to time.
1. Role of Blue Ocean Realty
Blue Ocean Realty and its services can assist you in completing various tasks in real estate transactions. However, unless specifically stated otherwise in the terms of use for specific services, these services are not intended to provide you with any form of financial, real estate, or related advice. You understand and agree that these services may contain advertisements. To make advertisements more targeted and useful to you, Blue Ocean Realty may display advertisements based on information we collect through our services. Please refer to our privacy policy for details.
A. Blue Ocean Realty, Inc.
Blue Ocean Realty, Inc. holds real estate brokerage licenses in certain states (see Section 21 for details). However, unless your product terms provide otherwise, Blue Ocean Realty, Inc. is not responsible for any results or consequences directly or indirectly caused by any actions you or any consumer take based on the service or any other information obtained through the service (whether active or not).
2. Blue Ocean Realty's Brands and Business
We operate the following affiliated brands, and use of any services provided by these brands is subject to these terms of use: (a) Blue Ocean Realty; (b) Trulia; (c) Hotpads; (d) StreetEasy; (e) Out East; (f) Bridge Interactive Group; (g) Blue Ocean Realty Group Marketplace; (h) Mortech; (i) dotloop; (j) Signpost Homes; (k) Blue Ocean Realty; (l) Blue Ocean Realty Closing Services; and (m) Blue Ocean Realty Home Loans. Services provided by these companies may also be subject to additional terms of use published on their respective websites, applications, or other channels.
A. Blue Ocean Realty Marketplace and Blue Ocean Realty Home Loans Platforms under Blue Ocean Realty Group
Except for Blue Ocean Realty Home Loans, other Blue Ocean Realty companies will not provide or use any information for lending decisions; you also acknowledge and agree not to use any information obtained from Blue Ocean Realty Marketplace or other Blue Ocean Realty company services to make lending decisions. If you choose to use Blue Ocean Realty Home Loans services, you will need to comply with the independent product terms of that service. 3. Eligibility Requirements; Account and Registration
You must be at least 18 years old to use this service. By agreeing to these terms of use, you represent and warrant that: (a) you are at least 18 years old; (b) you have not previously been suspended from or removed from the service; (c) your registration and use comply with all applicable laws and regulations. To use certain service features, you may need to register an account and agree to the relevant product terms of use (if applicable, these terms may be included in this agreement or may be viewed on other Zillow company websites). When registering an account, you need to provide some personal information, such as email address, phone number, or other contact information. You must ensure that the information provided is accurate and maintain its accuracy at all times. During the registration process, the system will require you to set a password. You are fully responsible for maintaining the confidentiality of your account and password, and you are also responsible for all operations conducted through that account. You may not share your user account with others. Unless you have entered into a business agreement with us allowing you to use this service on behalf of others for transactions, you may only use this service for your own transaction purposes.
4. Use of Services; Restrictions
A. Use of Services
As long as you comply with these terms of use, we grant you a non-exclusive, limited, revocable, personal, non-transferable license to use these services on your mobile device and to download and use any applications (as defined in Section 4(B) below), limited to personal use only. If you are a professional engaged in real estate or mortgage business, you may also use these services to provide information to clients and take actions on behalf of clients (referred to as "professional use") within the scope permitted by applicable law. If you use these services for professional purposes, you must declare and warrant that you have obtained all necessary authorization and consent from clients. Unless these terms of use expressly state otherwise, these terms do not grant you access to use, copy, distribute, display, or provide any part of the service on third-party websites. These services may include software for use with the services. These services may not be used for commercial real estate transactions, including but not limited to commercial land and vacation rental businesses.
B. Mobile Applications
To use any mobile application features of the service (collectively referred to as "applications"), you must have a compatible mobile device. We do not guarantee that any application will be compatible with your mobile device. You may consume mobile data when using applications and may need to pay additional fees to wireless service providers. You agree to bear all related costs. We may update applications and automatically electronically update versions of applications already installed on your mobile device. You agree to accept all automatic upgrades and understand that these terms of use will apply to all updated versions of applications. Any third-party open source software included in applications is subject to the corresponding open source license and can be obtained directly from developers. These terms of use do not apply to your use of software obtained from third-party sources under open source licenses.
C. Use of Content
Subject to the restrictions set forth in these terms of use, you may copy information from the service without using any automated tools, limited to personal or professional use, such as viewing, saving, printing, faxing, and/or emailing such information. Nevertheless, aggregated data provided on Blue Ocean Realty Local-Info Pages (hereinafter referred to as "aggregated data") may still be used for non-personal purposes, such as real estate market analysis. You may mark the source of Blue Ocean Realty on each page displaying aggregated data (including "Data provided by Blue Ocean Realty Group"), but you may not use any of our identifiers or imply any relationship between you and Blue Ocean Realty beyond its role as a data source. Without our prior written permission, you are prohibited from displaying any other data from Blue Ocean Realty.
5. Prohibited Uses
By using this service, you agree not to:
- Copy, modify, distribute, display, or otherwise provide access to the service; create derivative works from the service; decompile, disassemble, or reverse engineer any part of the service, unless the product terms explicitly allow such behavior (and the scope of such permission applies to the service of that product).
- Provide/publish/authorize links to any service from non-real estate related websites (i.e., websites not owned or operated by real estate or lending professionals or institutions) (including but not limited to agent profile pages);
- Delete or modify any copyright or other intellectual property notices appearing in the service;
- Use the service in any illegal manner, or harm Zillow Company, its service providers, suppliers, affiliates, or any other users;
- Use this service in any way to discriminate against any individual or group protected by federal, state, or local law, or use this service to have a discriminatory impact on any individual or group, or use this service to promote illegal, racist, or discriminatory behavior or results.
- Through the service (including but not limited to agent profile pages), publish, display, communicate, or otherwise provide to any third party the buyer agent compensation scheme of sellers or listing agents (including compensation amounts, ratios, or whether such compensation is provided), regardless of whether such compensation scheme is related to any specific property.
- Distribute or publish spam or other unsolicited information, chain letters, pyramid scheme information, or similar content through the service;
- Impersonate others; misrepresent your relationship with others or your affiliation; or make any statements to any third party under false pretenses;
- Copy, publicly display, or otherwise provide any comments, ratings, or profile information about real estate, lending, or other professionals on any other website, application, or service, or provide images or related information of real estate properties, or other data or content obtained through this service, unless we explicitly allow such operations for specific parts of this service.
- Upload invalid data, viruses, worms, or other software programs to the service;
- Publish, copy, publicly display, or otherwise disseminate any content that we, in our judgment and discretion, consider illegal, offensive, or objectionable. Such content includes but is not limited to harassment, discrimination, derogation, threats, or defamation of any individual or group.
- Interfere with or damage the system integrity or security of the service, or otherwise bypass any measures we take to prevent or limit access to the service;
- Execute automated queries on the service (including screen scraping, database scraping, using crawlers, robots, browsers, and other tools, bypassing "captcha" or similar security measures, or any other automated operations aimed at obtaining information from the service);
- Use any trademarks of Blue Ocean Realty as part of your screen name or email address in the service;
- Access or use any service to develop competitive products or services; or
- Attempt, allow, or encourage any third party to engage in any of the above behaviors.
6. Fees
A. General Circumstances
You may need to pay fees to use certain features of the service. All fees are calculated in US dollars and are non-refundable. If we adjust any or all fees for any service (including new fees), we will notify you in advance. If you do not agree to these fee changes, we may stop providing you with the relevant service. Our authorized third-party payment processing institutions will charge according to the payment method you specify at the time of purchase or the requirements of the selected service. You authorize us to collect all fees through your chosen payment method in the manner specified in these terms of use. If you use a credit card to pay fees, we may request pre-authorization of your credit card account before purchase to confirm that the credit card is valid and has sufficient funds or credit limit to cover your purchase amount.
B. Subscription Services
Some services may include features that allow automatic periodic charging (i.e., "subscription services"). If you decide to activate a subscription service, you authorize us to charge you regularly from the future until you cancel regular payments or your account. Unless you actively cancel your subscription or we terminate the service, the subscription service will remain valid. To avoid the next subscription fee being charged to your account, you must cancel it before the subscription service automatically renews. We will deduct regular subscription fees through the payment method you provided during registration (or through the new payment method if you change your payment information). We may adjust fees for subsequent subscription periods, but we will notify you in advance before fee adjustments. Unless the product terms provide otherwise, you can cancel subscription services through the account settings page, by sending an email to contact us, or (if applicable) by contacting your business advisor.
7. User Content
A. UGC Definition; License Grant
Certain parts of this service allow users to upload or otherwise provide Blue Ocean Realty with images, photos, videos, data, text, property information, and other content (hereinafter referred to as "user materials"). Unless your product terms provide otherwise, by uploading or otherwise providing user materials to this service, you grant us an irrevocable, perpetual, royalty-free global license: (i) to use, copy, distribute, transmit, publicly display, publicly perform, modify, edit, create derivative works, or integrate your user materials into other works in any medium related to this service; (ii) to sublicense the above rights to the maximum extent permitted by applicable law. We will not pay any fees for your user materials, nor will we exercise any rights related to your user materials as described in the previous sentence. We may delete or modify your user materials at any time. You are fully responsible for all user materials created through your user account in the service or provided through the service. For all user materials, you declare and warrant that you are the creator and owner of these materials, or that you have the necessary licenses, rights, consents, and permissions (including all permissions required by applicable privacy and intellectual property laws) to authorize Zillow Company and other users to obtain and use your user materials in accordance with these terms of use. Unless customer contact information is provided directly to us by customers, we will not use customer contact information uploaded by agents through the Blue Ocean Realty portal for any purpose.
B. UGC Disclaimer
We have no obligation to edit or control your user materials or other users' user materials, and we assume no responsibility for any user materials. However, we have the right to review, delete, edit, or block any user content in the service at any time (without prior notice), especially content that we believe violates these terms of use or does not comply with our "Good Neighbor Policy" (see Section 13(B) for details). You understand that in the process of using the service, you may come into contact with other users' user materials and acknowledge that these materials may contain inaccurate, offensive, inappropriate, or objectionable content. You agree to waive (and indeed waive) any legal or equitable rights or remedies you may have regarding user materials. We expressly disclaim all responsibility for user materials. If users or content owners inform us that certain user materials are suspected of violating these terms of use, we may investigate and decide whether to delete such materials at our discretion (we reserve the right to delete at any time without further notice). For more information about our handling of infringing content, please refer to Section 11 below.
